Journal of Research in Law and Political Science is a international academic semestrial scientific journal, edited by the Faculty of Law and Political Sciences of Ibn Khaldoun University (Tiaret,Algeria). It publishes original research in three languages: Arabic, French and English, and which its main interest of research is in general about law studies and Political Science. It aims to be a junction link between researchers from different countries of the world to encourage studies in public law. It targets a various audience from law researchers, magistrates, and law professionals (Lawyers and attorneys, notaries, bailiffs and auctioneers, company lawyers, public administrators, public institutions heads, law students, political sciences and management students too. The journal favors the interdisciplinary reflections which allow the approach of the law phenomenon from its various aspects. This dynamic of cross and interdisciplinary research will undoubtedly allow answering both the requirements of socio-economic in legal matter, as well as taking advantage of legal studies evolution in the rest of the world.

دور التشريع في الحد من المخاطر الصحية والبيئية للألعاب النارية

الملخص: يخلف إطلاق الألعاب النارية وانفجارها أضرارا ومخاطر تعرض صحة الإنسان للهلاك كالفزع والحروق وأمراض القلب والحساسية، إضافة إلى تلوث الهواء والمحيط بالدخان الذي تخلفه والنفايات التي تنتجها عملية تصنيعها. وهو ما دفعنا إلى البحث عن مكانة ودور الآليات القانونية التي توفر الحماية المثلى من هذه المخاطر والعمل على الحد منها أو تخفيفها قدر المستطاع، خاصة أمام تزايد وارتفاع نسبة الأضرار الأمر الذي يوحي بوجود عجز قانوني في احتوائها ومعالجتها. In addition to polluting the air and the surrounding environment, the release and explosion of fireworks can also cause damage and risks to human health, such as panic, burns, heart disease, and allergies. They produce smoke and debris from the manufacturing process. This prompts us to find the status and role of legal mechanisms to provide the best protection to these risks, and to strive to reduce or mitigate these risks as much as possible, especially considering the high rate of damage to health and the environment. They cause, which shows that it is impossible to legally control and deal with these damages.

الملخص: تزايد الاهتمام العربي بمراكز الفكر باعتبارها مولدات للمعرفة والابتكار العلمي ومنطلق التغيير الحقيقي نتيجة أدوارها الهامة في تحليل الظواهر وفهم مسبباتها وإمكانية التنبؤ بمساراتها وحدود آثارها، تسعى دراستنا الى البحث في واقع مراكز الفكر العربية وأدوارها في صناعة المستقبل وتغيير الواقع بما يضمن التقدم والتطور من خلال الوقوف على حجم الظاهرة، أدوارها، وتحديد معيقات عملها ومتطلبات تفعيلها، مع الإشارة الى منطلقات الاهتمام العربي بالدراسات المستقبلية، وأهمية توطينها عربيا واشراك مراكز الفكر العربية في رسم السياسات وتمكينها من أدوات البحث والتحليل ورفع العوائق أمامها. The increasing Arab interest in think tanks as generators of knowledge and scientific innovation and the starting point for real change as a result of their important roles in analyzing phenomena, understanding their causes and the possibility of predicting their paths, the Arab interest in future studies, the importance of Arab settlement and the involvement of Arab think tanks in formulating policies, enabling them to use research and analysis tools, and removing obstacles to them.

إمكانية منح الشخصية القانونية للروبوت

الملخص: أحدثت التطورات الالكترونية والتكنولوجيا ثورة كبيرة في كل المجالات المختلفة للحياة ،حيث انعكست عليها مثيرة عدة تحديات واشكاليات خاصة في بعض المجالات منها المجال القانوني ، فبعد التطورات السريعة للتكنولوجيا وصلت الاختراعات إلى صنع روبوتات ذكية عن طريق وضع خوارزميات مبرمجة بذلك هذا الكيان الآلي على التصرف بذكاء يحاكي ذكاء الإنسان الطبيعي. الشيء الذي أفرز لنا إشكال في الحقل القانوني في الشق المتعلق بمسؤولية هذا الكيان في حالة تسببه لضرر خاصة واننا عهدنا في القواعد الكلاسيكية للمسؤولية أن مسبب الضرر لا يمكن ان يكون إلا شخص معنوي أو طبيعي ،والشخص الآلي هو آلة صنعها الإنسان أصبح ينافس الإنسان في بعض مهامه و أعماله. غير أنه لا يملك شخصية قانونية لأنه لا يملك مقومات ومواصفات وشروط اكتسابها كشخص طبيعي أو معنوي مما يجعلنا أمام إشكال قانوني كبير خاصة في الحالات التي تحتاج لقيام مسؤولية قانونية نظراً لوجود خطأ سبب ضرراً موجباً للتعويض. Electronic developments and technology have brought about a major revolution in all different fields of life, as they have been reflected in, raising several challenges and problems, especially in some fields, including the legal field. After the rapid developments of technology, inventions have led to the creation of intelligent robots by developing programmed algorithms, thereby enabling this automated entity to act intelligently, simulating... Natural human intelligence. The thing that created a problem for us in the legal field is the aspect related to the responsibility of this entity in the event that it causes damage, especially since we know in the classical rules of responsibility that the cause of the damage can only be a legal or natural person, and the automated person is a machine made by humans that has become a competitor to humans in some ways. His duties and works. However, he does not have a legal personality because he does not have the capabilities, specifications, and conditions for acquiring it as a natural or legal person, which leaves us facing a major legal problem, especially in cases that require legal liability due to the existence of an error that caused damage requiring compensation.
