حجية البصمة الوراثية في إثبات الجريمة

الملخص
تعد الهندسة الوراثية واحدة من أهم اكتشافات التكنولوجيا الحديثة التي استخدمها المختصون في المجال الجنائي حيث تلعب البصمة الوراثية دورا حاسما في التعرف على هوية الأشخاص و من ثم التوصل إلى معرفة مرتكبي الجرائم أو الكشف عن أشخاص آخرين متواجدين في مسرح الجريمة لتمييزهم عن المشتبه فيهم و ذلك من خلال رفع العينة التي تم العثور عليها في مكان الجريمة إلى غاية تحليلها و مقارنتها مع العينة التي تؤخذ من جسد المشتبه فيه. و على الرغم من أهمية البصمة الوراثية في إثبات الكثير من الجرائم، فقد أثارت جدلا كبيرا خاصة حول قوتها الثبوتية، ففي الوقت الذي يوليها البعض أهمية كبيرة في معرفة هوية الأشخاص معرفة دقيقة لا تدع مجالا للشك لأن من مميزات هذه البصمة أنها تبقى محتفظة بخصائصها حتى بعد مرور عدة أيام من تركها على مسرح الجريمة، نجد في المقابل من لا يعول عليها في الإثبات الجنائي بالنظر إلى عدة عوامل خارجية من شأنها التأثير على قوتها في الإثبات، فالقصور في الجوانب الفنية أو العملية و هو الأكثر وقوعا من جانب الخبراء يؤدي أحيانا للإهدار الكامل للدليل الوراثي. Abstract: Genetic engineering is considered one of the most important discoveries of modern technology, used by specialists in the criminal field, and then the genetic fingerprint plays a crucial role in identifying people and the search for the perpetrators of crimes or the detection of other people on the crime scene to distinguish them from suspects through DNA analysis of the sample found at the crime scene and compare it with the sample taken from the body of the suspect. Despite the importance of DNA technology in this area of work, there is still some debate surrounding its acceptance as criminal evidence, some experts believe it to be one of great importance because one of the characteristics of this fingerprint is that it retains its characteristics even after several days of leaving it on the scene of the crime, whereas others cast doubt on its evidentiary value by reason of several external factors that influence their strength in proof, inadequate technical or practical aspects and is the one most frequently occurring from experts, sometimes leads to the complete waste of the genetic evidence. This paper aims to shed light on DNA and its evidentiary value before a criminal court, by addressing the most important uses of DNA in the criminal field and determine the binding force for this evidence. Résumé: Le génie génétique est considéré comme l'une des découvertes les plus importantes de la technologie moderne, utilisé par les professionnels du domaine pénal, alors L’empreinte génétique joue un rôle crucial dans l’identification des personnes et la recherche des auteurs des crimes ou de la détection d’autres personnes qui se trouvent sur la scène du crime pour distinguer sur les suspects en levant l’échantillon trouvé sur le lieu du crime jusqu’à l’analyse et la comparaison avec l’échantillon prélevé dans le corps du suspect. Malgré l’importance de L’empreinte génétique pour prouver de nombreux crimes, il a suscité une grande controverse surtout à propos de sa force probante.
