الحلول المتاحة لمواجهة أثر جائحة كوفيد19 عند تنفيذ الصفقة العمومية في القانون الجزائري.

الملخص
الملخص: تأثرت العقود الإدارية ولاسيما عقود الصفقات العمومية بجائحة كوفيد19 على غرار جميع العقود الأخرى وكان لها النصيب الأكبر في اختلال التوازن العقدي للطرفين، هذا ما عرقل استمرارية تنفيذ الصفقة العمومية سواء من حيث تلبية الحاجيات العامة للأفراد وضرورة توفير الخدمات أو من حيث حتمية التوقف عن انجاز المشاريع، إلا أن المشرع الجزائري وضع حلولا قانونية لمثل هذه الحالات من أجل ضمان استمرارية تنفيذ الصفقة من خلال تعليق توقيع الجزاءات المالية على المتعامل المتعاقد بسبب التأخر في الانجاز واللجوء إلى ابرام الملحق من جهة، ومن جهة أخرى تعديل الأسعار و إعادة التوازن المالي للصفقة. فالهدف و الأهمية من هذه الدراسة هو تقنين الأوضاع و الضوابط القانونية التي تعجز فيها القواعد القانونية للمرسوم الرئاسي 15/247 المتضمن تنظيم الصفقات العمومية على ضمان استمرارية تنفيذ الصفقة بسبب تفشي جائحة كوفيد 19 كظرف استثنائي و محاولة إيجاد قواعد تتلائم و هذا الظرف . Abstract: Administrative contracts represented in public transactions were affected by the Covid19 pandemic, as were all other contracts, and had the greatest share of the contract imbalance of the parties. this has hampered the continuity of the implementation of the public transaction, both in terms of meeting the general needs of individuals and the need to provide services, and in terms of the imperative to stop doing projects. However, the Algerian legislature has developed legal solutions to such cases in order to ensure continuity in the execution of the transaction by suspending the imposition of financial sanctions on the contracting agent owing to delays in completion and the conclusion of the attachment, on the one hand, and, on the other, adjusting the prices and restoring the financial balance of the transaction. The aim and importance of this study is It is an indication of the situation of the legal conditions and controls in which the legal rules of Presidential Decree 15/247, which includes the regulation of public deals, are unable to ensure the continuity of the deal’s implementation due to the outbreak of the Covid 19 pandemic as an exceptional circumstance and an attempt to find rules that fit this circumstance.
