التدخل الإنساني والتحول في مفهوم السيادة: انتقال المفهوم من التقديس إلى الوظيفية

الملخص
نتناول في موضوع هذه الورقة "مبدأ السيادة" الذي بات يواجه وضعا خطيرا، حيث أنه وفي ظل الحركيات المتسارعة التي عرفها النظام الدولي بدا للجميع انكماش نطاق السيادة، إذ دفع ذلك إلى نقل هذا المفهوم من الدلالة المطلقة إلى المرنة أو النسبية، لتكون السيادة في خضم القانون الدولي المعاصر في حدها الأدنى منتقلة من التقديس إلى الوظيفية، وذلك من واقع بعض الحجج المستحدثة في بعض القيود التي تتيح التدخل في شؤون الدولة الداخلية، كالقول بعدمية الديمقراطية أو عدم احترام حقوق الإنسان فيها، وهذا ما دفع بعض الباحثين إلى التأكيد على زوال أو اختفاء ظاهرة السيادة الوطنية، وهو حكم يراه البعض الأخر مبالغا فيه نوعا ما، إلا أن هناك اتفاقا على خطورة ما طرأ على السيادة الوطنية للدول المتوسطة، والنامية بصفة خاصة. abstract: In the subject of this paper, we address the “principle of sovereignty,” which is now facing a dangerous situation, as in light of the accelerating movements that the international system has witnessed. It has seemed to everyone that the scope of sovereignty is shrinking, as this has prompted the transfer of this concept from absolute significance to flexible or relative significance. So that sovereignty is in the midest of Contemporary International law has at a minimum, moved from sanctification to functionality, based on some of the arguments developed in some restrictions that allow interference in the internal affairs of the state, such as the statement of the lack of democracy or lack of respect for human rights in it. This is what prompted some researchers to emphasize the disappearance or disappearance of the phenomenon of National sovereignty, which is a judgment that others consider somewhat exaggerated, but there is agreement on the seriousness of what happened to the national sovereignty of medium-sized countries, and developing countries in particular.
