أزمة الطرف الثالث المؤتمن وكتابة العدل الالكترونية

الملخص
تعني المهن الخاصة بالتوثيق والتصديق سواء في الصورة التقليدية أو الالكترونية بتنظيم وضبط العلاقات ومسك سجلاتها، لاضفاء الموثوقية وتوثيق هاته المعاملات ، هذا المركز النظامي الذي يشغله هؤلاء الأعوان ـو الضباط العموميون لا يتم اكتسابه أو الانتساب اليه الاّ وفق شروط صارمة في مختلف التشريعات ، ويطلق على هذا النمط من النشاط الطرف الثالث المؤتمن. بعد الأزمة المالية العالمية لسنة 2008 تزعزعت الكثير من مقوّمات ومظاهر الحياة الاقتصادية وامتدّت الى المجال القانوني وتحديدا بعد ظهور بيان مانيفستو ساتوشي ناكاموتو الذي أعلن عن ميلاد البيتكوين العملة المشفرّة الثورية ودعامتها البلوكتشين وصولا الى تقويض المنظومة التقليدية للعقد فيما يعرف بالعقود الذكية مما أدى الى تهديد الوسطاء الماليين والوسطاء القانونيين وضرب مركز الطرف الثالث المؤتمن مما يستوجب دراسة هذه الظواهرالقانونية والاقتصادية واحتوائها Abstract: (Do not exceed 150 words) The professions of documentation and certification, whether in the traditional or electronic form, mean organizing and controlling relationships and keeping their records, to add reliability and document these transactions. After the global financial crisis of 2008, many components and aspects of economic life were shaken and extended to the legal field, specifically after the appearance of Satoshi Nakamoto’s manifesto, which announced the birth of Bitcoin, the revolutionary cryptocurrency, and its pillar, Blockchain, leading to the undermining of the traditional contract system known as smart contracts, which led to the threat of financial intermediaries.
