الملخص
ملخص: يعد الشّحن البحري أهم وسيلة نقل في العالم حيث يرتكز الشحن الدولي عليه، ويتّم عن طريق السفن والبواخر بأحجامها المختلفة،وعملية شحن البضائع ورصّها التزام يقع على عاتق الناقل البحري يعهد بها إلى مقاولين متخصصين في الشحن والتفريغ. ومنه فقد تناولت هذه الدراسة بالبحث عمليتا شحن البضائع ورصّها على متن السفن العادية والحاويات سواء كان الشحن داخل عنابر أو سطح السفينة، وهذا في ظل القانون البحري الجزائري والمعاهدات الدولية المنظمة للنقل البحري للبضائع، وما تثيره هاتين العمليتين من إشكالات قانونية ،إذ أصبحت أغلب المنازعات القانونية التي تثور بين الناقلين والشاحنين حول عمليتي الشحن ورص البضائع،حيث تناولت كل من اتفاقية بروكسل نظاما خاصا يختلف عن الأحكام التي أخذت بها معاهدة هامبورغ و قواعد روتردام. Abstract: the marine Shipping of The goods promises more important mean of transportation in the world, where the international Shipping concentrates on him, Road of the Ships and the different Ships is complete about Shipping operation lost and pressing here it is observance Falls under the responsibility of the marine transporter knows in her to two specialized contractors so in the Shipping and the empty ring. This paper aims to Study operation Shipping of the goods and pressing her aboard the normal ships or the snack container where the Shipping was in side of the ware houses or on surface of the Ship, under the international conventions that organize the carriage of goods by sea. Considering that the bruxelles rules, take very different approaches to the issue of deck cargo from the homburg and Rotterdam rules.
